In & Out Gardens introduces its new rewards program.

In addition to our amazing product line and service, In & Out Gardens now offers its customers the opportunity to earn rewards with every eligible purchase.  Customers that become Rewards Members will earn a 10% in-store credit for every $1,000 in Eligible purchases* from an In & Out Gardens store.  Rewards credits may be used immediately on additional purchases or additional sales can earn additional rewards credits which accumulate through the calendar year.
 
Rewards credits may be used at any time during the calendar year in which they are earned.  Each January 1st the Rewards Program starts over.

Eligibility.  To become a Rewards Member, you pay a one-time $20.00 fee.  When you become a Rewards Member, we will begin tracking your purchases, and calculate any Rewards credits earned each calendar year.  There are no annual fees or additional costs, but remember, you must use your Rewards credits during the calendar year in which they are earned.

Terms. The In & Out Gardens Rewards Program is subject to the following conditions:

1. Customer must provide their membership number at the time of each purchase, in order for that purchase to qualify for the Rewards program.
2. Rewards credits earned during a calendar year must be used on in-store purchases during the same calendar year.
3. Rewards credits may be redeemed only in the In & Out Gardens Store that they were earned and does not apply to online purchases.  If a product is returned for a refund, and Rewards credits issued as a result of the original purchase have already been used, the redeemed, Rewards credit will be deducted from the amount of the refund.
4. The laws of the state in which the In & Out Garden Store-in-question resides, without regard to its conflict of laws rules, will govern these Terms.  If any legal action relating to the customer’s use of the Rewards Program or these terms, the customer agrees to file such action only in the state and federal courts located in the county in which the store-in-question is conducted.
5. In & Out Gardens reserves the right to change or terminate the Rewards Program, or any portion thereof, at any time.  The Rewards Program structure is subject to modification, or limitation in the sole discretion of In & Out Gardens at any time with or without notice, and In & Out Gardens reserves the right to modify the current Rewards redemption values, to establish additional Rewards redemption values or even to delete any or all of the current Rewards redemption values.
6. Any fraudulent use of the Rewards Program will automatically revoke any and all benefits and the right to any further participation in the Rewards Program.
7. In & Out Gardens failure to exercise or enforce any right or provision of the Rewards Program shall not constitute a waiver of such right or provision unless acknowledged and agreed to by In & Out Gardens in writing.
8. This Rewards Program may not be combined with any other offer unless specifically communicated in writing.
9. The interpretation and application of the policies, procedures, or rewards of the Rewards Program are in the sole discretion and determination of In & Out Gardens, which in each case shall  be final and conclusion.
10. Customers that choose to withhold contact information are responsible to keep track of either their cards, the Member ID#, or the password needed to redeem earned rewards.

*Exclusions.  Purchases of soil, products bundled in a special sale offering, special orders, and posted products do not qualify as purchases for Rewards credits.  In Addition, use of gift certificates and gift cards do not earn Rewards credits.
